Daniele Salami Lawsuit Against Spice Companies Over Salmonella

A Daniele salami Salmonella lawsuit has been filed against spice suppliers Wholesome Spice and Seasonings Inc. of Brooklyn, N.Y., and Mincing Trading Corp. of Dayton, N.J., according to news reports.1 Daniele, Inc. has recalled more than one million pounds of ready-to-eat salami (salame) since January because of a Salmonella Montevideo outbreak that was linked to contaminated spices used in the meats and supplied by Wholesome Spice and Mincing Trade Corp.

Daniele is now suing these suppliers in the U.S. District Court of Rhode Island for negligence and alleging that the spice companies “breached ‘their express and implied warranties’ that the products they sold to Daniele were safe.” Black pepper and crushed red pepper that Daniele purchased from Wholesome Spice and Mincing in 2009 were found to contain the same strain of Salmonella that was associated with a Salmonella outbreak that sickened more than 200 people and hospitalized at least 37 in 44 states. “Daniele has terminated its relationship with the supplier and is now using only irradiated pepper,” wrote Daniele President of Sales Davide Dukcevich in a letter to consumers posted on the company’s Web site.

The amount Daniele is seeking in damages is unspecified. Meanwhile, some who were sickened in the outbreak are filing their own Salmonella lawsuits against Daniele, Mincing and Wholesome Spice. In one such lawsuit, filed in Cook County Circuit Court, a Chicago man alleges he suffered weeks of fevers and other symptoms after eating the tainted salami.2 In filing the lawsuit, Daniele stated the company anticipates more future losses in light of the cost of the recall, the cost of claims filed against the company, and also the discovery of another Salmonella strain in their product: Salmonella Senftenberg.
